A Muldrow man is scheduled for an August 28 arraignment in Sequoyah County District Court after being charged with chid sexual abuse, stemming from an incident that allegedly occurred in November 2023.
David P. Humphrey, 54, was charged on July 25 and a warrant was issued for his arrest the same day. He received a $20,000 bond, according to court documents.
Riley Brooks with the Muldrow Police Department reported on Nov. 24, 2023, that after being dispatched to a domestic in progress, he requested Cpl. Nick Yoakum to come to the scene due to a reported sexual assault at the residence.
Brooks said a child under the age of 12 reportedly confessed to a family member that Humphrey had allegedly touched the minor inappropriately. He was then arrested at the scene after it was confirmed he had outstanding warrants through both the town and county.
After being taken into custody, Humphrey filled out a statement, stating he and the minor were playing games at the table and that “is all that happened.” Brooks later served Humphrey with an emergency protective order while Humphrey was incarcerated in the Muldrow jail, according to the probable cause affidavit filed in the case.
Yoakum reported an interview with the alleged victim was later set up at the Child Advocacy Center in Sallisaw, where the alleged victim said they were sitting at a table with another individual, playing with toys. When the other individual left, Humphrey allegedly told the minor there were toys in his bedroom that the minor could play with. The minor alleged that Humphrey “hugged and sat them on his bed,” and they were unable to get away from him because “they were not strong enough.”
The minor said the next day, they told a family member what had allegedly occurred and that family members confronted Humphrey, before contacting authorities.
District Attorney Jack Thorp said if found guilty of the crime, it is punishable by imprisonment in the custody of the Department of Corrections not exceeding life, or by imprisonment in a county jail not exceeding one year, or by a fine of not less than $500 nor more than $5,000, or both fine and imprisonment.
