A man with addresses in both Muldrow and Sallisaw has been charged after failing to comply with his sex offender registration.
The felony charge was filed on February 29 in Sequoyah County District Court against Hershell W. House, 56, and a warrant was issued for his arrest the same day, according to court records. He is now scheduled to appear for a March 13 felony disposition docket before Associate District Judge Kyle Waters Sallisaw Police Lt. Mark Rutherford reported receiving information on Feb. 26 that House, a registered sex offender, was staying at a residence with his girlfriend on Cherokee Street in Sallisaw.
Rutherford spoke with House’s girlfriend at the police department, stating that House could not stay at her residence because it was located within 2,000 feet of a city park, swimming pool and the Boys and Girls Club.
When asked about staying at her residence, the girlfriend said he was there for at least two nights in a row and possibly a third, according to the probable cause affidavit filed in the case. The girlfriend also stated she’d told House he could not stay there because he would get into trouble for doing so, and that House understood that.
Rutherford reported House is registered as a sex offender in Sequoyah County and resides at a residence on Badger Lee Drive in Sallisaw, according to the affidavit. He got out of prison on Dec. 8, 2023, after being convicted of first degree rape (victim under the age of 14), child sexual abuse and lewd molestation in 2019.
District Attorney Jack Thorp said if found guilty of the charge, it is punishable by incarceration in a correctional facility for not more than five years and a fine not to exceed $5,000, or both fine and imprisonment.
